Subject: Court Allows City of Carlsbad to Intervene in C4FA Case on AA Flights

I am happy to inform you that the court proceeding went very well this morning, resulting in a BIG WIN for the City of Carlsbad,  C4FA, PAAN and North County Citizens and Supporters

The County and AA attorneys pressed hard to NOT allow the City of Carlsbad to intervene in the lawsuit regarding the AA flights.

The City of Carlsbad Attorney presented the City case for intervening very clearly and directly, with his points pretty much supported by the Judge,

 Judge Pollock allowed the City of Carlsbad to join in the lawsuit, emphasizing the following:

  1. The City of Carlsbad Conditional Use Permit provides a land use interest and jurisdiction that is a major issue impacting the matter
  2. The City has natural interests in being concerned about the safety of their residents in light of the AA flights.
  3. The City overall interests very much align with those of the plaintiff (C4FA)

So onward we go….Next Court Date is December 19, when the case begins.
